Jonathan Grasso is a Member who practices regionally and nationally representing a diverse range of business clients in the areas of complex commercial litigation, restructuring, bankruptcy, collections, out-of-court workouts and other creditors’ rights matters. Specifically, Mr. Grasso has substantial experience representing business debtors, business owners and officers, landlords, secured and unsecured creditors, creditors’ committees, trustees, and liquidating trusts in matters generally ranging up to $100 million.

Mr. Grasso’s commercial litigation experience includes representing plaintiffs and defendants in shareholder disputes, securities violations, breach of contract actions, embezzlement, negligent misrepresentations, fraudulent conveyances, breach of fiduciary duty claims and construction disputes.

Within Mr. Grasso’s creditors’ rights practice, he pursues and defends against a variety of collection actions, such as debtor’s interrogatories, wage and bank garnishments, successor liability lawsuits and the foreclosure of real estate and personal property. His bankruptcy practice includes handling all aspects of the Chapter 11 process for all parties-in-interest in a bankruptcy proceeding, including first day motions, relief from the automatic stay, assumption and rejection of leases, plan confirmation, objections to claims, and adversary proceedings.

  • Digital Marketing Company Workouts. Achieved multiple workouts for business debtor resulting in the resolution of over $8 million in defaulted debt in total.
  • Chapter 11 Debtors. Successfully reorganized Chapter 11 debtors in numerous industries including construction, healthcare, entertainment, transportation, manufacturing, hotels, religious organizations, lumber, and retail.
  • Subchapter V Brewery Debtor. Confirmed one of, if not the first Subchapter V bankruptcy plan in Long Island, New York on behalf of craft brewery debtor.
  • Official Committees of Unsecured Creditors. Represented unsecured creditors’ committees in numerous industries including construction, healthcare, technology, and manufacturing.
  • Creditors in Mega-Bankruptcy Cases. Represented international manufacturers, landlords, and other parties-in-interest in some of the largest retail bankruptcy cases in the country including Rite Aid, Sears, K-Mart, Toys “R” Us, Ann Taylor and J. Crew.
  • Bankruptcy Liquidation Trust. Settled trust’s claims against former directors and officers of cryptocurrency debtor with claims exceeding $700 million.
  • Fraudulent Transfer Defendants. Defended over one hundred medical practices in fraudulent transfer and false claims act adversary proceedings in a diagnostic laboratory bankruptcy.
  • Embezzlement Plaintiff. Resolved multimillion–dollar embezzlement suit brought by construction company against former CEO.
  • Securities Violation Plaintiff. Recovered full initial investment plus attorneys’ fees on behalf of securities violation claimant.
  • Travel Company Defendant. Resolved hundreds of customer claims brought against travel company client relating to trip cancelations because of the COVID-19 pandemic.
  • Secured Creditor Foreclosures. Represented financial institutions and individual secured creditors in the foreclosures of substantially all assets of various businesses, including real estate, tangible personal property and intangible personal property.
